The most dangerous men (and women) in America, at least where our liberty is concerned, may be wearing black robes and presiding over our courtrooms. Yes, I’m talking about judges at all levels, but particularly Federal Judges, who are appointed for life terms.
A classic example of those is Judge James Boasberg, who is Chief Judge of the United States District Court for the District of Columbia. I suggest you do a little research on this man. Although originally nominated to the federal bench by George W. Bush, he is anything but Republican-leaning in his decisions.
Appointed to the “FISA” court by SCOTUS Chief Justice John Roberts, he later was the judge who presided over the trials and sentencing of many of the J-6 defendants. His rulings and sentencing were, to say the least, brutal. Except for Ray Epps, that is, the FBI informant who was recorded on video exhorting a crowd to “Go INSIDE the Capitol Building” while people around him shouted “FED, FED!” Epps was sentenced to a slap on the wrist, one year of probation, and no jail time. Now, Boasberg is engaged in a legal embroglio with President Trump and his attempts to deport some of the most dangerous illegal aliens in our country, members of the Tren de Aragua gang from Venezuela.
Unbelievably, Boasberg is maintaining that Trump, through I.C.E. and the Department of Homeland Security, had no right to send them to El Salvadore, whose government agreed to place them in a maximum security prison there, after Venezuela refused to accept them back into their home country.
In effect, Boasberg is claiming that he, an unelected federal appointee, is the sole authority to determine the legal status of individuals who have entered and remained in our country in violation of our immigration laws. Incredibly, Chief Justice Roberts appears to be supporting him in that claim. This, if it stands, will precipitate the “Constitutional Crisis” that the Democrats shrilly claim already exists.
As many Constitutional scholars of various political persuasions maintain, Article II of the Constitution clearly gives the President and the Executive Branch authority to deal with these matters. It is the job of Congress to pass the immigration laws, which they did, and the job of the Executive branch to enforce them, which, until Trump was elected, it clearly hasn’t.
When our Founding Fathers debated and adopted our Constitution in 1787, the average life expectancy for Americans was 36 to 38 years of age. So, a lifetime appointment to the Judiciary only lasted for a few years. Now, since it hovers around 80, someone appointed in their mid-30s can expect to serve for over 45 years! This clearly needs to change.
Because of the difficulty of removing a federal judge from their position, a rogue judge can wreak havoc in our court system, which has, and continues to happen, on a not-too-rare basis. Term limits for our politicians and judiciary need to be established as they are for the Executive Branch.
Finally, we must accept the fact that the judiciary is hardly impartial in its decisions. They are, after all, human beings like the rest of us, subject to their political leanings and social prejudices. Not to recognize that fact is foolish in the extreme.
As Barack Obama pointed out after his election in 2008: “Elections have consequences.” In his case, he used his election to divide this country rather than unite it racially and politically by “Fundamentally Transforming America.” The 2024 election dramatically demonstrated that Americans believe we have been going in the wrong direction for years.
Now, rather than accept that judgment, the Democrats have decided to once again use the principles of “Lawfare” to achieve results they couldn’t get at the ballot box. We can’t allow that to happen, or we truly will lose our country forever. President Trump and his administration know that. It is past time for all patriotic Americans to support him in his efforts. Judges like James Boasberg must be brought to heel. Our liberties depend upon it.
